NIL Partnership Program Terms of Service

Terms & Conditions – Athlete Brands NIL Partnership Program

By joining the NIL Partnership Program provided by Athlete Brands LLC, a Colorado-registered marketing agency (“Agency”), you (“Athlete”) agree to the following terms. Please read them carefully.

1. Nature of Services

Athlete Brands LLC provides marketing, branding, and NIL support services. These may include:

  • Brand introductions and communication

  • Custom merchandise store setup and promotion

  • Athlete content creation, exposure, and UGC (User-Generated Content) opportunities

  • Paid advertising management using athlete content

  • Social media promotion and affiliate campaign access

We do not offer legal advice, legal representation, or contract negotiation. Athletes are encouraged to consult with personal legal or financial advisors for formal agreements.

2. Non-Exclusive & Voluntary Participation

This is a non-exclusive and voluntary arrangement. Athletes are free to work with other agencies, collectives, schools, and brands. You are never obligated to accept an opportunity. Athlete Brands LLC does not apply to NIL deals or represent you legally.

3. Content Opportunities & Compensation

You may be invited to participate in brand-related content projects. If accepted:

  • You will be paid the agreed amount per project (commonly 100% of your quoted rate).

  • You grant limited rights to use your content/NIL for that campaign only..

  • Merchandise profits are split 80/20 (athlete/agency) unless otherwise stated.

  • Brand Partnerships & Internal Network

    As part of the NIL Partnership Program, Athlete Brands LLC may provide promotional opportunities, sponsorships, and NIL deals through its own affiliated or directly managed brands. These partnerships are offered as legitimate NIL activations and may include commission-based codes, paid content posts, or merchandise collaborations.

    By enrolling in this program, the athlete acknowledges and agrees that some NIL deals may originate from brands owned or operated by Athlete Brands LLC. All partnerships provided through this network will involve real marketing deliverables and comply with standard NIL guidelines.

     

4. Compliance, Payments & Reporting

  • Payments are typically sent monthly via PayPal or agreed method.

  • You are responsible for accurate tax reporting and compliance disclosure to your school or institution.

  • We are not liable for payment delays caused by incorrect information.

5. One-Time Program Fee

A one-time $29 onboarding fee covers store setup, NIL tools access, and promotional support. This fee is non-refundable as services begin immediately upon enrollment.

6. Athlete Conduct & Expectations

By joining, you agree to:

  • Maintain professionalism in all content and brand interactions

  • Accurately represent your stats, image, and social presence

  • Avoid behavior that may damage brand partnerships or violate NCAA/school policies

7. Transparency & Consent

We will never use your NIL in any brand campaign without your written consent. Every opportunity will include clear terms, deliverables, and pay structure before you participate.

8. Eligibility

By joining, you affirm that:

  • You meet all NCAA/state/institutional NIL eligibility requirements

  • You will notify your compliance office of any compensation

9. Termination

You may leave the program at any time with written notice. Athlete Brands may also remove you at its discretion. Final payouts (if any) will be processed within 30 days. Your content and promotion will be removed, but you retain all earned income.

10. Disclaimer

Athlete Brands LLC is a marketing agency—not a legal representative. We cannot guarantee NIL deals or earnings. Opportunities depend on athlete performance, brand fit, location, and social media activity. All partnerships are subject to brand approval.

Refund Policy

We are committed to providing immediate value and resources upon sign-up. Due to the nature of our services—which include personalized graphics, NIL network placement, brand opportunity preparation, and content strategy—we do not offer same-day refunds or cancellations.

All refund requests must be submitted within 7 days of purchase, and are only considered if no services or resources have been delivered or used. Once any part of the program has been accessed, including graphics, platform invites, NIL deal placement, or merchandise setup, refunds are no longer eligible.

We encourage all athletes to review the program details before enrolling and reach out with any questions. Our team is always available to provide clarity before purchase to ensure this program is the right fit.

Program Timeline & Deliverables

Athlete Brands operates as an ongoing NIL support program. Upon enrollment, we begin delivering value immediately, and key deliverables are provided within an estimated 7 to 60 days, depending on brand timelines, content approvals, and merchandise production.

Your deliverables include:

  • Official Partnership Announcement Post

  • Custom Merchandise Collection & Store Setup

  • Merchandise Launch Post

  • MOGL Invitation for Deal Access

  • At Least One NIL Deal Opportunity

We work to ensure every athlete receives lasting value and real opportunities while building their brand over time.

By joining via email or platform, you acknowledge these Terms & Conditions and agree to participate voluntarily and transparently under this non-agent marketing program.
